These Terms and Conditions apply to painting, decorating and associated services provided under the HousePaint Pro brand by Houseklein Limited, Company Registration Number 15907606, registered office at 167-169 Great Portland Street, London, W1W 5PF ("HousePaint Pro", "we", "us" or "our"). By accepting a quotation, paying a deposit, confirming a booking or otherwise instructing us to commence work, you agree to these Terms and Conditions.
1. Our Services
HousePaint Pro provides professional painting, decorating and related property-improvement services. Services may include interior painting and decorating, preparation of walls and ceilings, filling and sanding, woodwork painting, wallpaper removal or installation where agreed, feature walls, minor surface preparation and other decorating work specifically included within the customer's quotation. Only work expressly included within the accepted quotation or written confirmation forms part of the agreed service.
2. Quotations and Estimates
Quotations are based on the information reasonably available to us at the time, including photographs, videos, measurements, descriptions supplied by the customer and, where applicable, an inspection of the property. Where a quotation is provided remotely, it assumes that the condition of the property is reasonably consistent with the information supplied. If, after work begins, we discover circumstances that could not reasonably have been identified from the information provided - such as significant surface damage, extensive cracking, damp, defective plaster, multiple layers of wallpaper, unstable surfaces or substantially greater preparation requirements - we will inform the customer before carrying out material additional work. Any additional work and associated charges should be agreed before that additional work proceeds. A quotation does not include work that has not been expressly stated within its scope.
3. Property Viewings
Where we consider an inspection necessary before providing or confirming a quotation, a viewing may be arranged. Our standard painting/commercial viewing fee is £50, unless otherwise stated. Where applicable, the viewing fee may be deducted from the final cost if the customer subsequently proceeds with the qualifying service, subject to the terms communicated when the viewing is booked.
4. Booking and Deposits
A booking is not considered fully confirmed until any required deposit has been received and confirmation has been issued by HousePaint Pro. For larger or multi-day projects, we will normally require a 50% deposit, unless a different payment arrangement is stated in the quotation. The remaining balance is payable in accordance with the payment schedule stated in the quotation or invoice and, unless otherwise agreed, upon completion of the agreed work. Payment may be made using the payment methods communicated by HousePaint Pro, including bank transfer or an approved electronic payment link.
5. Customer Responsibilities
The customer is responsible for providing reasonable and safe access to the property at the agreed time and ensuring that areas scheduled for decorating are reasonably accessible. Unless specifically included within our quotation, customers should remove or secure valuable, fragile and personal items from the work area. We will take reasonable precautions to protect floors, furniture and other areas affected by our work. Customers should nevertheless identify particularly valuable, delicate or unusual items before work begins. The customer must disclose any known hazards or relevant property conditions that could affect the work, including damp, unstable surfaces, asbestos or suspected asbestos, electrical hazards, structural defects or other safety concerns.
6. Paint and Materials
Unless expressly included within the quotation, paint and specialist materials are supplied by the customer. Where the customer supplies paint or other materials, the customer is responsible for ensuring that the products are suitable, of adequate quality and available in sufficient quantities. HousePaint Pro cannot guarantee the performance, coverage, finish, colour accuracy or durability of materials supplied or selected by the customer where an issue results from the characteristics, quality or suitability of those materials. Where we purchase materials on the customer's behalf, the applicable cost will be included within or added to the quotation as agreed.
7. Colour Selection
Final colour selection remains the customer's responsibility. Colours may appear different depending on lighting, surrounding colours, surface texture, paint finish and screen/display settings. Where colour approval is required, work carried out using a colour approved or supplied by the customer will not normally be considered defective merely because the customer subsequently changes their preference.
8. Surface Preparation and Existing Defects
Professional decorating requires appropriate preparation. The amount of preparation included will be determined by the agreed scope. Unless specifically quoted, our service does not constitute structural repair, specialist damp treatment, plastering, building work or remediation of underlying defects. Existing cracks, movement, water damage, damp, defective plaster, previous poor workmanship or other substrate problems can affect the finished appearance and longevity of decorating work. We cannot guarantee that cracks or defects caused by structural movement, settlement, moisture or failure of the underlying surface will not subsequently reappear. Where additional preparation becomes necessary, we will discuss this with the customer where it materially changes the agreed scope or price.
9. Additional Work and Variations
Requests made after the original quotation has been accepted - including additional rooms, ceilings, doors, skirting boards, architraves, cornices, woodwork, repairs, preparation or additional coats - may constitute additional work. Additional work may result in additional labour, materials and time charges. Where reasonably practicable, the additional cost will be communicated and agreed before the variation is undertaken.
10. Access and Delays
Customers must ensure that our decorators can access the property at the agreed date and time. HousePaint Pro will make reasonable efforts to attend according to the agreed schedule. However, completion dates may occasionally be affected by circumstances outside our reasonable control, including drying times, unexpected surface conditions, material availability, access problems, illness or other operational circumstances. Where a delay occurs, we will communicate revised arrangements as soon as reasonably practicable.
11. Cancellation and Rescheduling
Customers should provide at least 48 hours' notice when cancelling or materially rescheduling a confirmed appointment. Where less than 48 hours' notice is provided, a cancellation or rescheduling charge may apply where permitted by law and where we have incurred or are likely to incur reasonable losses as a result. For larger projects, any treatment of a deposit following cancellation will depend on the circumstances, work already undertaken, materials ordered, labour reserved and the customer's applicable statutory cancellation rights. Nothing in these Terms limits cancellation rights that consumers have under applicable UK consumer law.
12. Completion and Inspection
Customers are encouraged to inspect the completed work as soon as reasonably practicable. Where possible, a final walkthrough may be undertaken with the customer or their representative. If the customer identifies an issue, they should notify HousePaint Pro promptly and provide sufficient information, photographs or videos where appropriate so that the matter can be assessed. We should normally be given a reasonable opportunity to inspect and, where appropriate, remedy an alleged workmanship issue before the customer commissions another contractor to alter or repair the relevant work.
13. Our 100% Satisfaction Guarantee
Our 100% Satisfaction Guarantee reflects our commitment to delivering the agreed work to a professional standard. If a customer identifies a genuine workmanship issue relating to work completed by HousePaint Pro, the customer should notify us promptly. We will assess the concern and, where it results from our workmanship and falls within the agreed scope, arrange reasonable remedial work without an additional labour charge. The guarantee does not automatically entitle the customer to a full or partial refund. The guarantee does not cover matters arising from:
- pre-existing defects or structural movement;
- damp, leaks or moisture;
- defective or unstable plaster or substrates;
- normal wear and tear;
- accidental or deliberate damage after completion;
- work performed or altered by another contractor or person;
- unsuitable or defective materials supplied by the customer;
- colour or finish preferences that were previously approved;
- defects resulting from matters outside our reasonable control; or
- work that was not included within the agreed quotation.
This guarantee operates in addition to, and does not replace or restrict, any statutory rights available to consumers.
14. Complimentary Post-Service Cleaning
Where stated as part of the service, HousePaint Pro provides complimentary cleaning of areas reasonably affected by our decorating work following completion. This is intended to remove reasonable decorating-related dust and debris and leave the immediate working areas presentable. It is not a professional deep clean, end-of-tenancy clean or whole-property cleaning service unless separately purchased and expressly included within the quotation. The complimentary cleaning service does not require us to restore the property to a particle-for-particle representation of its condition before work commenced. Additional professional cleaning can be arranged separately where required.
15. Damage to Property
We take reasonable care when working within customers' properties and use appropriate protective measures according to the nature of the project. Any alleged damage should be reported promptly and, where possible, before the relevant area is altered, repaired or disposed of so that we have a reasonable opportunity to inspect it. Where HousePaint Pro accepts responsibility for damage caused through our failure to exercise reasonable care and skill, we will work with the customer to determine an appropriate remedy. The provision of an inspection, cleaning or remedial action does not, by itself, constitute an admission of liability. Nothing in these Terms excludes or limits liability where doing so would be unlawful.
16. Decorators and Service Personnel
Services may be performed by HousePaint Pro personnel or suitably selected decorators, tradespeople or subcontractors working on our behalf. HousePaint Pro remains responsible for providing the contracted service in accordance with the applicable agreement and UK law. Customers should direct contractual, payment, complaint and service-related matters to HousePaint Pro rather than making separate arrangements with personnel assigned to the project.
17. Photographs and Video
We may photograph or record relevant work areas before, during and after a project for legitimate purposes such as documenting property condition, monitoring workmanship, quality assurance and resolving disputes. Any use of identifiable photographs or videos for marketing purposes will be subject to appropriate permission or another lawful basis where required.
18. Complaints
We aim to resolve concerns professionally and fairly. Customers should provide their name, property address, booking or invoice details, a clear description of the concern and relevant photographs or videos where appropriate. We may arrange an inspection where this is reasonably necessary to investigate the matter. Making a complaint does not automatically suspend an undisputed payment obligation, although disputed matters will be handled in accordance with applicable law.
19. Consumer Rights
Nothing in these Terms and Conditions is intended to exclude, restrict or replace a customer's statutory rights. Where the customer is acting as a consumer, services will be provided in accordance with applicable UK consumer protection legislation, including the requirement to perform services with reasonable care and skill. Where a statutory consumer right conflicts with these Terms, the statutory right will prevail.
20. Website Information
We take reasonable care to ensure information published on the HousePaint Pro website is accurate. Photographs, descriptions, example projects, prices and other website content may be illustrative. A website price or description does not replace a project-specific quotation unless expressly stated otherwise.
21. Privacy and Personal Information
Personal information supplied to HousePaint Pro will be handled in accordance with our Privacy Policy and applicable UK data-protection legislation. Customer information will only be used and shared as reasonably necessary to administer enquiries, bookings, payments, service delivery, customer support and other legitimate business activities, or where otherwise permitted by law.
22. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Where the customer is a consumer, nothing in this clause deprives them of any mandatory rights regarding the jurisdiction in which a dispute may be brought.
